Glucose Graph Tool Terms of Service

1. Acceptance of Terms
By accessing or using the Glucose Graph Tool app (referred to as "the App") and any related services, you agree to comply with and be bound by the following Terms of Service. If you do not agree to these terms, please do not use the App.
2. Description of Service
The App allows users to transform data from your Freestyle Libre Glucose Monitor into the iconic Glucose Goddess-style graphics. This App is a graph tool and only works with data from the Freestyle Libre Link app.
3. User Registration
3.1. You may be required to create an account to use certain features of the App.
3.2. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.3. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. Privacy
Your use of the App is also governed by our Privacy Policy, which can be found here. By using the App, you consent to the practices described in the Privacy Policy.
5. User Conduct
5.1. You agree not to use the App for any illegal or unauthorized purpose, or in any manner that violates applicable laws or regulations.
5.2. You agree not to transmit any harmful code, viruses, or any other destructive content through the App.
6. Intellectual Property
6.1. All content and materials available in the App, including but not limited to text, graphics, logos, icons, images, and software, are the property of Glucose Goddess LLC or its licensors and are protected by copyright and other intellectual property laws.
6.2. You may not use, reproduce, modify, distribute, or publicly display any content from the App without including a credit to Glucose Goddess.
7. Disclaimer of warranty
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
8. Limitation of liability
To the extent permitted by law, Glucose Goddess LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
9. Refund Policy
Glucose Goddess LLC does not process direct refunds for purchases of the App. All transactions are handled through the respective app store (e.g., Apple App Store, Google Play Store), and any request for refunds must be directed to the app store from which the purchase was made. Refund requests are subject to the terms and conditions of the app store. Users are encouraged to familiarize themselves with the refund policy of the respective app store.
To request a refund, users should follow the refund process provided by the app store. This typically involves accessing your account on the app store, locating the transaction, and selecting an option to 'Report a problem' or 'Request a refund.' Refund eligibility for app purchases is determined by the app store's policy. Glucose Goddess LLC is not responsible for the app store’s decision regarding the approval or rejection of refund requests.

Glucose Goddess LLC reserves the right to terminate or suspend your access to the App at any time, without notice, for any reason, including, without limitation, breach of these Terms of Service.

Glucose Goddess LLC reserves the right to change or modify these Terms of Service at any time. Any changes will be effective immediately upon posting the updated terms on the App. Your continued use of the App after such changes will signify your acceptance of the new terms.
12. Disclaimer Regarding Medical Use
12.1. The App is intended for informational and visual representation purposes only. It is not a medical device, and the information provided through the App should not be considered as medical advice or a substitute for professional medical judgment.
12.2. You acknowledge that the data and graphs generated by the App are based on the glucose data you input, and any discrepancies or inaccuracies in the data may affect the accuracy of the graphs and visual representations.

12.4. Glucose Goddess LLC makes no warranties or representations regarding the accuracy, reliability, or suitability of the App for medical purposes. You use the App at your own risk, and Glucose Goddess LLC disclaims any liability for any consequences arising from your use of the App for medical or health-related decisions.
12.5. The App is not intended for use in emergencies. In case of a medical emergency, please seek immediate medical attention by calling your local emergency services or healthcare provider.
